1. Agreement & Acceptance

By using the Transporter app or website, you agree to these rules. If you don't agree, you cannot use our services. You must be at least 18 years old.
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Transporter ("we", "us", or "our"), governing your access to and use of the Transporter website, mobile application, and related transport and logistics services (collectively, the "Platform").
Please read these Terms carefully before registering or using the Platform. By creating an account, booking a ride, offering transport services, or accessing any logistics features, you agree to be bound by these Terms. If you do not agree to these Terms, you must immediately cease using the Platform.
You must be at least 18 years of age and have the legal capacity to enter into binding contracts under South African law to register for an account and use the Platform.
2. The Services We Provide

We are a tech platform that connects riders, drivers, taxi associations, and cargo shippers. Transporter itself does not own vehicles or operate taxi services.
Transporter provides a technology platform that connects riders with independent third-party transport providers (such as ride-hailing drivers and minibus taxi operators) and connects shippers with freight fleet operators.
Important Clarification: Transporter is not a transport carrier or provider. We do not operate passenger transport, taxi services, or logistics fleets, and we do not employ drivers. All transport services are provided by independent third-party operators who are not employees, agents, or joint venturers of Transporter.
We make reasonable efforts to verify operators and provide scheduling tools, route maps, and pricing models, but we do not guarantee the performance, safety, or quality of the transport services delivered by independent partners.
3. Accounts & Verification
In plain English:
Keep your login info secure. If you are a driver, you must provide correct licensing, permit, and vehicle documents. We verify these to ensure safety.
To access most features of the Platform, you must register for and maintain an active personal user account. You agree to provide accurate, complete, and up-to-date information during registration and keep it current.
You are responsible for all activity that occurs under your account and agree to maintain the security of your username and password at all times.
For drivers and fleet operators, registration is subject to document verification, including but not limited to: valid driver's licenses, Professional Driving Permits (PrDP), vehicle roadworthy certificates, passenger liability insurance, and taxi operating permits. Transporter reserves the right to reject any registration or suspend any user account if documents are invalid, expired, or falsified.
4. Rules of Conduct & Safety

Be respectful. Do not damage vehicles, do not harass passengers or drivers, and obey the law. We have zero tolerance for violence or abuse.
When using our Platform and services, you agree to:
- Treat all other users, drivers, passengers, and support staff with respect and dignity.
- Not cause nuisance, annoyance, inconvenience, or property damage to any third-party transport provider or rider.
- Comply with all applicable South African laws, including road safety laws and municipal bylaws.
- Not transport illegal items, dangerous materials, or contraband on the Platform.
Transporter enforces a zero-tolerance policy regarding harassment, discrimination, verbal abuse, physical violence, and sexual misconduct. Any reports of such conduct will result in immediate and permanent account suspension.
5. Fares, Payments & Cancellations

Fares are calculated and shown upfront. We handle credit card payments and pay drivers. Cancellation fees may apply if you cancel a trip late.
Use of the Platform may result in charges for the services you receive from independent transport providers ("Charges").
- Upfront Pricing: For ride-hailing and freight logistics, estimated charges are displayed prior to booking. Minibus taxi and bus route bookings are subject to fixed schedules and fares as defined on the app.
- Payment Methods: Payments can be made via credit/debit card, digital wallet, or cash (where applicable). Card transactions are processed securely via our PCI-DSS compliant third-party payment gateways.
- Cancellation Fees: If you cancel a ride request after a driver has already been dispatched and traveled a significant distance, or if you fail to show up at the pickup point within the grace period, you may be charged a cancellation fee.
- Tolls & Surcharges: Fares are inclusive of standard route tolls and dynamic peak pricing (surge pricing) where applicable.
6. Intellectual Property Rights
In plain English:
We own the Transporter app, logos, and software. You get a limited license to use the app for personal trips or logistics, but you cannot copy or resell it.
All intellectual property rights in the Platform, including logos, source code, designs, text, database structures, and trademarks, are owned by Transporter or our licensors and are protected by South African and international copyright, trademark, and patent laws.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-sublicensable, revocable, non-transferable license to download and use the Transporter application on your personal mobile device solely in connection with your use of the Services.
You may not copy, modify, distribute, sell, lease, reverse engineer, or decompile any part of our Platform or software.
7. Limitation of Liability & Indemnity
In plain English:
We do our best, but we are not liable for traffic delays, accidents, lost property, or disputes between riders and drivers. You agree to protect us if you break the rules.
To the maximum extent permitted by South African law, Transporter provides the Platform on an "as is" and "as available" basis, without warranties of any kind.
Transporter shall not be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost data, personal injury, or property damage arising out of, in connection with, or otherwise resulting from any use of the Platform or services.
You agree to indemnify and hold Transporter and its officers, directors, employees, and agents harmless from any and all claims, demands, losses, liabilities, and expenses (including legal fees) arising out of or in connection with: (i) your use of the Services; (ii) your breach or violation of any of these Terms; or (iii) your violation of the rights of any third party, including independent transport operators.
8. Termination & Account Closure

You can delete your account at any time. We can suspend or delete your account if you violate these terms or act unsafely.
You may terminate these Terms at any time by requesting the deletion of your account and ceasing all use of the Platform.
We reserve the right to temporarily suspend or permanently terminate your account, block your access to the Platform, or restrict certain features if we reasonably believe you have violated these Terms, compromised the safety of other users, or engaged in fraudulent activity.
Upon termination, all licenses granted to you under these Terms will immediately cease. Provisions regarding Intellectual Property, Limitation of Liability, Indemnity, and Governing Law will survive any termination of this agreement.
9. Governing Law & Dispute Resolution
In plain English:
These terms follow the laws of South Africa. Any major legal disputes will be resolved through South African arbitration or courts.
These Terms, and all relations, disputes, or claims arising out of or in connection with them, shall be governed by, and construed in accordance with, the laws of the Republic of South Africa.
In the event of any dispute, controversy, or claim arising out of these Terms, you and Transporter agree to first attempt to resolve the issue amicably through mediation or informal negotiations.
If informal negotiations fail, the dispute may be referred to arbitration in Johannesburg under the rules of the Arbitration Foundation of Southern Africa (AFSA), or submitted to the jurisdiction of the High Court of South Africa (Gauteng Local Division, Johannesburg).
